Familiarization with customs inspection materials: amendments to the law take effect from November 14
At the initiative of the Constitutional Court of the Russian Federation, the law stipulates that the person being inspected (or his representative) may familiarize himself with the customs inspection materials without separate permission from the head of the inspection body or his deputy. This applies to documents that do not concern, for example, state secrets.
Customs will provide the materials no later than 5 working days from the date of submitting the application in any form. The representative must have a notarized power of attorney.
The person being inspected will have the right, among other things, to copy and photograph documents, as well as to make extracts. Currently, such a possibility is not provided for in the Law on Customs Regulation.
It will be possible to familiarize with the documents containing information that is not subject to disclosure by customs in the form of an extract. Moreover, such materials must include, among other things, data on violations of legislation identified during the inspection.
