For a highly qualified specialist from abroad to obtain permission to carry out work activities on the territory of the Russian Federation, an employment contract must be submitted. Based on this, the relevant contract is concluded before documents are sent to the Ministry of Internal Affairs, however, its entry into force relates to a later period.
The Ministry of Labor has clarified the provisions on the procedure for an employment contract with a foreign worker coming into force. In particular, it is permissible to include a condition in the contract regarding its entry into force, for example, with the following wording: "from the day the specialist is actually admitted to work, provided they have a work permit." At the same time, after the foreign citizen obtains the relevant permit, amendments must be made to the employment contract.
The department also drew attention to the procedure for notifying the Ministry of Internal Affairs about the hiring of a foreign citizen. Such notification must be sent precisely after the conclusion of the employment contract, within a period not exceeding three working days.
